Tidal Automations ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, and safeguard information when you interact with our services, including any SMS communications.
We may collect your name, phone number, business name, email address, and information you provide during conversations with our AI SMS agents. We collect this information when you contact us, fill out a form on our website, or interact with an automated SMS agent deployed by a Tidal Automations client.
By providing your phone number to one of our clients and engaging with our SMS system, you consent to receive text messages from that business. Message frequency varies based on your interaction. Standard message and data rates may apply.
We use collected information to respond to your inquiries, route leads to our clients, improve our automation systems, and comply with legal obligations. We do not use your information for unrelated marketing.
We do not sell, trade, rent, or otherwise transfer your personal information to third parties for their marketing purposes. Full stop.
We may share your information with the business you contacted (our client), our service providers (such as Twilio for SMS delivery), and when required by law. All service providers are contractually required to protect your information.
We retain conversation data for a maximum of 12 months unless our client instructs otherwise or we are legally required to retain it longer.

These Terms and Conditions ("Terms") govern your use of services provided by Tidal Automations. By using our services or interacting with any SMS agent we operate, you agree to these Terms.
Tidal Automations builds and operates AI-powered automation systems including missed call SMS agents, lead capture workflows, and business process automation for small business clients. Services are provided on a custom, per-client basis.
Our SMS systems are deployed on behalf of local business clients. All SMS communications comply with the Telephone Consumer Protection Act (TCPA) and CTIA guidelines.
You agree not to use our services or SMS systems to send spam, harass individuals, transmit unlawful content, or interfere with system operations. We reserve the right to terminate access for violations.
All content, automation logic, and systems built by Tidal Automations are our intellectual property. Client-specific configurations and conversation data belong to the respective client.
Our services are provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, specific business outcomes, or a particular volume of leads. AI systems may occasionally produce inaccurate responses.
Tidal Automations shall not be liable for indirect, incidental, or consequential damages arising from use of our services. Our total liability shall not exceed the fees paid in the three months preceding a claim.
These Terms are governed by the laws of the State of South Carolina. Any disputes shall be resolved in Georgetown County, SC.
We may update these Terms at any time. Continued use of our services after changes constitutes acceptance of the new Terms.
